ARTICLE 1 - DEFINITIONS

The terms used in these Terms and Conditions mean:

Customer - a natural person, legal entity, or organizational unit without legal personality, to which the law grants legal capacity, who places an Order in the Store;

Consumer - according to the Civil Code, means a natural person who performs a legal act with an entrepreneur that is not directly related to their business or professional activity.

Civil Code

Terms and Conditions - these Terms and Conditions that specify the general conditions of sale and rules for the provision of electronic services within the online store healthylife.es;

Online Store (Store) - the website available at https://healthylife.es/, through which the Customer can, in particular, place Orders;

Goods - products presented in the Online Store;

Sales Agreement - a sales agreement for Goods as defined by the Civil Code, concluded between healthylife.es and the Customer, concluded using the Store’s website;

Consumer Rights Act - the government act;

Act on Electronic Services - the Act of 18 July 2002 on electronic services (Journal of Laws No. 144, item 1204, as amended);

Order - the Customer's declaration of intent to conclude a Sales Agreement, specifying in particular the type and quantity of Goods;

Dropshipping - a logistical model used in online sales, which involves handing over the process of shipping goods to a supplier. The role of the online store in this logistical model is limited to collecting orders and passing them on to the supplier, who ships the goods to the customer.


SECTION 2 - GENERAL PROVISIONS

These Terms and Conditions specify the rules for using the online store available at https://healthylife.es/.

These Terms and Conditions are provided pursuant to Article 8 of the Act on Electronic Services.

The online store healthylife.es, operating at https://healthylife.es/, is run by PAULINA DANIELA TROJAN, AVD ZARAGOZA 6,2,1, 03130 Santa Pola - Alicante, VAT ID Y4301281L. The business activity is registered by the minister responsible for the economy.

These Terms and Conditions specify, in particular:

  • The rules for registering and using an account within the online store;
  • The terms and conditions for placing Orders electronically within the online store;
  • The rules for concluding Sales Agreements using the services provided by the Online Store.

Using the online store is possible provided that the computer system used by the Customer meets the following minimum technical requirements:

a) access to electronic devices connected to the public network (Internet), also via analog mobile telephony,
b) an active email address,
c) a web browser that allows the display on a computer screen of hypertext documents (HTML) connected to the Internet via an internet service, Internet Explorer version 6.0 or newer with Java applets enabled or Mozilla Firefox version 2.0 or newer with Java applets enabled, or Opera version 9.0 or newer with Java applets enabled, or Google Chrome version 2.0 or newer with Java applets enabled, or Apple Safari version 3.0 or newer with Java applets enabled, minimum screen resolution 1024 x 768 pixels.


ARTICLE 3 - RULES FOR USING THE ONLINE STORE

Registration in the Online Store is optional. The Customer may place an order without registering in the Store, after previously reading and accepting these Terms and Conditions.

Registration is done by completing and accepting the registration form available on one of the Store's web pages.

The condition for registration is the acceptance of the Terms and Conditions and providing the personal data marked as mandatory.

Healthylife.es may deprive the Customer of the right to use the Online Store and limit their access to some or all of the Online Store’s resources with immediate effect if the Customer violates these Terms and Conditions, especially if the Customer:

  • Provided false, inaccurate, outdated, misleading, or infringing third-party rights data during registration in the online store;
  • Violated the personal rights of third parties through the online store, in particular, the personal rights of other online store customers;
  • Engaged in other behaviors that Healthylife.es deems contrary to applicable law or the general principles of Internet use, or harmful to the good name of Healthylife.es.

A person who has been deprived of the right to use the online store may not register again without the prior consent of Healthylife.es.

To ensure the security of message transmission and data in connection with the services provided on the website, the Online Store takes technical and organizational measures appropriate to the degree of security risk of the services provided, in particular, measures aimed at preventing the acquisition and modification of personal data transmitted on the Internet by unauthorized persons.

The Customer is obligated to:

  • Use the Online Store in accordance with the law in force in the Republic of Poland, the provisions of the Terms and Conditions, and the general principles of using the Internet;
  • Not provide content prohibited by law, such as content that promotes violence, defames, or violates the personal rights and other rights of third parties;
  • Use the Online Store in a way that does not interfere with its functioning, in particular by using specific software or devices;
  • Refrain from actions such as: sending or posting unsolicited commercial information (spam) within the Online Store;
  • Use the Online Store in a way that is not burdensome for other customers and Healthylife.es;
  • Use any content posted within the Online Store only for personal use.

ARTICLE 4 - PROCEDURE FOR CONCLUDING A SALES AGREEMENT

To conclude a Sales Agreement through the Online Store, one must go to the website https://healthylife.es/ and select the Goods, taking further technical steps based on the messages displayed to the Customer and the information available on the website.

The selection of the Goods ordered by the Customer is made by adding them to the cart.

When placing an Order - until the button confirming the placement of the Order is pressed - the Customer has the option to modify the entered data and the selected Goods. For this purpose, one should follow the displayed messages and the information available on the website.

After providing all necessary data by the Customer using the Online Store, a summary of the placed Order will be displayed. The summary of the placed Order will include, among others, a description of the selected goods or services, the total price, and all other costs.

To send the Order, it is necessary to accept the Terms and Conditions, provide personal data marked as mandatory, and press the button confirming the sending of the Order.

Information about the Goods presented on the Store’s website, particularly their descriptions, technical and usability parameters, and prices, constitute an invitation to conclude a contract within the meaning of the Civil Code. The Customer's submission of the Order constitutes a declaration of intent to conclude a Sales Agreement with healthylife.es, in accordance with these Terms and Conditions. After placing the Order, the Customer receives an email containing all the essential elements of the Order. This email only confirms receipt of the Order and does not constitute a declaration of intent to conclude a contract. The contract is deemed concluded when the Customer receives a second email containing the final confirmation of all the essential elements of the Order. This email constitutes a declaration of intent confirming the acceptance of the Order and the conclusion of a Contract with healthylife.es.

We sell some products on our website in the form of dropshipping, i.e., we act solely as intermediaries between the buyer and the distributor and do not physically own the product. The product is shipped directly from the distributor to the customer.

Healthylife.es has the right to withdraw from the contract if it turns out that the product purchased by the customer is defective and is not in the supplier’s stock. In such a case, we will refund the full amount to the customer’s account.

The contract is concluded in Spanish, and its content is in accordance with the Terms and Conditions.


ARTICLE 5 - DELIVERY

Delivery of the Goods is made to the address provided by the Customer when placing the Order.

The delivery period is 30 business days from the conclusion of the Sales Agreement unless a different period is indicated in the item description or when placing the Order.

Delivery of the ordered Goods is carried out via a courier company.

The cost of delivery is borne by the Customer unless the Sales Agreement provides otherwise.

Delivery costs are indicated at the time of placing the Order.

Customers can collect the ordered products in their country. For international orders, delivery will be made by an external service provider. The store is not responsible for issues related to delivery, including problems related to compliance with local laws in each country where the order is received.


ARTICLE 6 - PRICES AND PAYMENT METHODS

The prices of the Goods are expressed in euros and do not include delivery costs.

The Customer can pay the price:

  • By bank transfer to the Seller's bank account;
  • By online bank transfer;
  • By credit card.

ARTICLE 7 - RIGHT TO WITHDRAW FROM THE CONTRACT

A Customer who is a Consumer, in accordance with Article 27 of the Consumer Rights Act, has the right to withdraw from a contract concluded at a distance without giving any reason, by submitting an appropriate statement in writing within 14 days. To meet this deadline, it is sufficient to send the statement before its expiry. The Customer should return the product within 14 days of withdrawing from the contract.

The 14-day period is counted from the date of delivery of the Goods.

The Customer may withdraw from the Contract by sending a withdrawal statement to the Seller's email address or using the contact form available on the Store's website.

In the case of withdrawal from a contract concluded at a distance, the contract is considered not concluded. What the parties have provided is returned unchanged unless a change was necessary within the limits of ordinary use. The return should be made immediately, no later than within 14 days.

The Seller will refund the amount paid by the Customer, including shipping costs, using the same payment method used by the Customer unless the Customer expressly agreed to a different refund method that does not involve any costs for them. The Seller may withhold the refund until the returned Goods are received.

The Customer bears only the direct costs of returning the Goods unless the Seller agreed to bear these costs or did not inform the Customer of the necessity of bearing these costs.

The right to withdraw from a contract concluded at a distance does not apply to customers who are not consumers.


ARTICLE 8 - COMPLAINTS ABOUT GOODS

Healthylife.es as a seller is responsible for physical or legal defects of the Goods under the conditions specified in the Civil Code.

Complaints resulting from the violation of the Customer’s rights guaranteed by law or under these Terms and Conditions should be sent to the email address: shop@healthylife.es.

To consider the complaint, the Customer must provide personal data and a description of the reasons for the complaint.

Healthylife.es undertakes to consider each complaint within 14 days, and if this is not possible, to inform the Customer when the complaint will be considered.

Healthylife.es is not the manufacturer of the products. The manufacturer is responsible for the product warranty under the conditions and for the period specified in the warranty card attached to the Products. If the warranty document provides for it, the Customer may also submit their claims under the warranty directly to the authorized service, whose address is in the warranty card.


ARTICLE 9 - COMPLAINTS RELATED TO ELECTRONIC SERVICES

Healthylife.es takes actions to ensure the full functionality of the Store’s website, to the extent resulting from the current technical knowledge and undertakes to remove any irregularities reported by the Customers within a reasonable time.

The Customer may report any irregularities or interruptions in the functioning of the Store's website.
